Terms of Service & DMCA Policy

1. Accounts

Uploading videos, submitting scores, entering matches or saving targets requires an account. You agree to provide accurate information, keep your credentials secure, and tell us promptly about unauthorized use.

2. User content & target rules

No copyrighted material that isn’t yours. You may only upload, stream or embed videos, audio, images, artwork and target backgrounds that you own or have permission to use. Uploading third-party copyrighted material without authorization is prohibited.

No targets depicting people. You may not create, upload, print or share targets containing photos, depictions, caricatures or likenesses of politicians, public officials, candidates, or any other real person, living or deceased. Such targets will be removed without notice and the account may be suspended or terminated.

3. Ownership & license

Creators keep full ownership. You retain all ownership and copyright in the videos, images, artwork and other media you create and upload. These Terms do not transfer ownership to Airgun Fun.

License to Airgun Fun. By uploading, saving, publishing or sharing content — including targets, target designs and backgrounds, scored target images, videos and comments — you grant Airgun Fun a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, distribute, publish and otherwise use that content, including in galleries, leaderboards, printable and downloadable target files, and promotion of the Platform.

4. Target use restrictions

Targets available on Airgun Fun are provided for personal, non-commercial use only. You may not download, print, distribute, sell or otherwise use any target for commercial purposes unless you own the rights to that target. Commercial use of any other target requires written permission from Airgun Fun.

5. DMCA copyright policy

Airgun Fun respects intellectual property rights and responds to notices of alleged infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. We do not pre-screen all user content; when we receive a valid notice, we act expeditiously to remove or disable access to the material identified.

Takedown notices

A notice must include:

1. A physical or electronic signature of the copyright owner or a person authorized to act for them;
2. Identification of the copyrighted work claimed to be infringed;
3. Identification of the infringing material and its location on the Platform (such as the page URL);
4. Your name, address, telephone number and email address;
5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.

Fair use

Some uses of copyrighted material are permitted without permission under fair use (17 U.S.C. § 107), such as criticism, commentary, news reporting, teaching and parody. Under Lenz v. Universal Music Corp., copyright owners must consider fair use before sending a takedown notice. Knowingly misrepresenting that material is infringing may create liability under 17 U.S.C. § 512(f).

Counter-notices

If you believe your content was removed by mistake or misidentification, you may send a counter-notice to dmca@airgunfun.com including:

1. Your physical or electronic signature;
2. Identification of the removed material and where it appeared before removal;
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which Airgun Fun may be found) and will accept service of process from the person who sent the original notice.

We will forward a valid counter-notice to the original complainant. Unless they notify us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.

Repeat infringers

Each valid takedown that is not successfully countered results in a copyright strike. Accounts that receive three strikes will be terminated and their content removed. We may terminate any account immediately for willful or egregious infringement.

6. Disclaimers

The Platform, targets, scoring results and content are provided “as is” and “as available” without warranties of any kind. You are solely responsible for safe airgun handling and range practices. To the fullest extent permitted by law, Airgun Fun is not liable for injury, damage or loss arising from your use of the Platform or printed targets.

7. Governing law & changes

These Terms are governed by the laws of the United States and applicable state law. We may update these Terms; continued use after changes means you accept them. Questions: dmca@airgunfun.com
